Terms of Use
These Terms of Use (the "Terms") govern your access to and use of the Confer iOS app, App Clip, and the website at getconfer.app (together, the "Service"). The Service is operated by Yaroslav Petriv (the "Operator"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using it, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms in your jurisdiction.
2. Your account
You sign in with Apple. You are responsible for the activity that happens under your account and for keeping your Apple ID secure. Notify us at privacy@getconfer.app if you believe your account has been compromised.
3. Your content
You own the content you put on your card — your name, tagline, bio, photo, and social handles ("Your Content"). You grant the Operator a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display Your Content for the sole purpose of operating the Service (for example, showing your card to people who scan your QR code). This license ends when you delete Your Content or your account, except for backup copies retained for a short period and content that has already been shared with others.
You represent that you have the right to share Your Content, that it is accurate, and that it does not infringe anyone else's rights.
4. Acceptable use
You agree not to use the Service to:
- Impersonate any person or misrepresent your affiliation with any person or organization.
- Post content that is unlawful, harassing, hateful, defamatory, sexually explicit, violent, or that depicts or promotes self-harm or illegal activity.
- Post content that infringes intellectual property, privacy, or publicity rights of others.
- Upload malware, exploit vulnerabilities, scrape the Service, or attempt to bypass rate limits, authentication, or moderation systems.
- Collect information about other users without their consent.
- Use the Service in violation of applicable law or these Terms.
5. Moderation and removal
We may remove content and suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or to the Service. You can report objectionable content from within the App Clip or the full app, or by emailing privacy@getconfer.app. We aim to act on reports promptly.
6. Intellectual property
The Service — including the app, App Clip, the Confer name and logo, and the website — is owned by the Operator and is protected by copyright, trademark, and other laws. These Terms grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for its intended purpose. No other rights are granted.
7. Third-party services
The Service relies on third parties including Apple (Sign in with Apple, App Store, App Clip, APNs), Supabase, and Vercel. Your use of those services is governed by their own terms. The Service may include deep links to third-party apps (LinkedIn, Instagram, X, WhatsApp); we are not responsible for the content or behavior of those apps.
8. Apple App Store terms
If you obtained the app through the Apple App Store, Apple's standard Licensed Application End User License Agreement applies in addition to these Terms. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the app. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you.
9. Termination
You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, governing law) will survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THE OPERATOR'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.
12. Indemnification
You agree to defend and indemnify the Operator against any claims arising from Your Content, your use of the Service, or your violation of these Terms.
13. Changes to the Service or Terms
We may modify the Service or these Terms at any time. If we make material changes to the Terms, we will update the effective date and notify you in-app or by email before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the Operator resides, without regard to its conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise.
